Who is a Patent Agent?
A Patent Agent is a qualified professional registered under the Patents Act, 1970, who is authorized to practice before the Patent Office. They assist inventors, startups, research institutions and companies by drafting patent specifications, filing applications, responding to examination reports, and representing applicants in hearings, as provided under Section 2(1)(n) and Section 127 of the Act.
Patent Agent Examination
The Patent Agent Examination is conducted by the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM).

Paper I
The Patents Act, 1970 (39 of 1970), The Patents Rules, 2003, The Designs Act,
2000 (16 0f 2000) and The Designs Rules, 2001. -
Paper II
Drafting and interpretation of patent specifications, design specifications and other documents.

The qualifying examination consists of the following papers:
Passing Criteria (Rule 110(3), Patents Rules, 2003)
A candidate is required to secure a minimum of fifty marks in Paper I and Paper II and shall be declared to have passed the examination only, if he obtains an aggregate of sixty per cent of the total marks.
